THE INSIDER SA STAFF CHALLENGE – TERMS AND CONDITIONS

Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgment of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.

1. Introduction

1.1. The Insider SA Staff Challenge (Competition) will be run by Cardova Trading (Pty) Ltd (Cardova) in association with Capitec Bank Limited (Capitec).

(collectively the organisers/we/us/our).

1.2. Each person entering the Competition (entrants/you/your) and/or accepting the prize in terms of this Competition agrees and accepts that the Competition rules as set out in these terms and conditions are binding on him/her.

2. Who can participate

2.1. Only the employees of Capitec and its subsidiaries and employees of Cardova and its related entities, who reside in the Republic of South Africa, (collectively referred to herein as Employees) will be eligible to receive a prize, or prizes, in terms of this Competition.

2.2. Spouses, life partners, business partners or immediate family members and any other persons related to the employee are not eligible to participate in or enter the competition.

2.3. All employees directly involved with the deriving, production, management or marketing of the competition are not eligible to participate in or enter the competition.

3. Competition Period and Entry Periods

3.1. The Competition will commence at 09h00 on Monday, 2 August 2021 and will run for an indefinite period until we announce, through internal email correspondence, that the Competition is closed (Competition Period).

3.2. There will be a weekly prize giveaway throughout the Competition Period. The entry period for the first week’s weekly prize giveaway will commence at 09h00 on Monday, 2 August 2021 and close at 23h59 on Saturday, 14 August 2021. The entry period for the next prize giveaway will commence at 09h00 on the following day (i.e. the Monday) and close at 23h59 on the next Saturday and so on, until the organisers announces that the Competition is closed. For the avoidance of any doubt, you can enter for each weekly prize giveaway between 09h00 on Monday until 23h59 on the Saturday during that week.

4. How to Participate

4.1. To be eligible to win a prize herein, you must:

4.1.1. first provide your Twitter handle, email address, name and surname to the email address indicated on the Competition notice; and then

4.1.2. engage with The Insider SA Twitter profile, with specific reference to content included in this week’s episode, in one or more of the ways listed below during the entry period for each weekly prize giveaway:

4.1.2.1. Include the hashtag #TheInsiderSA on a Twitter post, a retweet or a reply on Twitter; or

4.1.2.2. Tag the Twitter Handle @TheInsiderSA on a Twitter post, a retweet or a reply on Twitter.

4.1.3. ensure that your Twitter account is ‘public’ and not ‘private’.

4.2. If you participate in a manner that in the sole discretion of the organisers will provide you with an unfair advantage over other Employees, you will be disqualified from the Competition. Simply tagging The Insider SA with #TheInsiderSA does not qualify as a valid post, reply or retweet for the purposes of this Competition.

4.3. If you have won a prize in this Competition, you will not be entitled to win another prize in any of the next 4 (four) prize giveaways from the one for which you have won. For the avoidance of any doubt, if you have won a prize herein, you will only be eligible to win a prize again from the 5th prize giveaway (and onwards) from the prize giveaway for which you won. 4.4. You are required to attend to the cost for your entry, including standard internet costs.

5. How the winners are determined

5.1. The winners of that week’s weekly prize giveaway will be the 2 (two) Employees indicated on the Brand24 media monitoring tool (https://brand24.com/) to have made the most mentions of The Insider SA’s Twitter hashtag (#TheInsiderSA) and/or handle (@TheInsiderSA) during the entry period for that weekly prize giveaway, provided that a minimum of 3 (three) valid mentions/posts have been made for that Competition Period.

5.2. We will notify winners by email within 48 hours from the closing of the entry period of the weekly prize giveaway.

6. The Prize

6.1. The prize for each weekly giveaway will be a Takealot.com voucher to the value of R500.00 (five hundred rand) (Prize) per winner.

6.2. The Prize will be emailed to the Winner.

6.3. Use of the Voucher will be subject to the standard terms and conditions for use of such Gift Cards as promulgated by Takealot.com from time to time

6.4. The organisers reserve the right to change the Prize for specific weeks at its discretion by sending out a notice to Employees per email that the prize for a specific week will be different, in which case the details of the prize for the week and any specific terms and conditions that may be applicable to that prize will be included in the aforementioned email notice.

6.5. Prizes are not transferable and may not be exchanged for cash or any other items. We reserve the right to substitute the Prize with any other prize of comparable commercial value.

7. General

7.1. Any reference to the organisers includes the directors, members, partners, agents or consultants of the organisers, where the context allows for it.

7.2. We reserve the right to amend these terms and conditions should it be deemed necessary in our sole and unfettered discretion.

7.3. The organisers’ decision regarding any matter concerning the Competition and/or arising out of these terms and conditions, including the determination of the Winner, is final and no correspondence will be entered into.

7.4. Where relevant, if a winner does not accept a prize as required herein, if an entry is not valid for whatever reason, if a winner has breached these terms and conditions, if a winner renounces the prize or we deem such winner to have renounced the prize, we reserve the right to declare the prize forfeited and/or choose a new winner.

7.5. By entering this Competition, the entrant consents to the collection, processing and further processing of his or her personal information (including personal information contained in electronic communications) by us for the purposes of conducting this Competition and facilitating the entrants participation in the Competition. Except where prohibited by law and subject to the Participants right to expressly accept, decline and withdraw consent or participation, the winner grants permission for us, and those acting under our authority, to use his or her name and or photographs for purposes of announcing the winner in correspondence to employees of Capitec, its subsidiaries and Cardova and its related entities, in any form of media and without additional compensation, notification or permission.

7.6. By entering the Competition, the entrant unconditionally and irrevocably indemnifies and holds harmless the organisers, as well as its holding company, its subsidiaries and any subsidiaries of its holding company, and their successors and assigns, directors, employees, agents or consultants against all and any losses, claims, proceeding, actions, damages, (direct, consequential or otherwise) liability, demands, expenses, legal costs (on an attorney and own client basis) howsoever arising out of, based upon, or in connection with (directly or indirectly) the entrant’s participation in the Competition and the prizes.

7.7. The organisers and its service providers, are not responsible for:

7.7.1. incorrect and inaccurate transcription of entry information;

7.7.2. technical malfunction;

7.7.3. inappropriate images and comments posted by entrants or by the public;

7.7.4. lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network or computer equipment or software;

7.7.5. the inability to access any website or online services or any other error; and/or

7.7.6. Content posted by participants on their twitter account.

7.8. If required by the organisers for whatever reason, we will have the right to modify or terminate this Competition with immediate effect and without notice of such modification or termination. In such event, all entrants hereby waive any rights, which they may have against us and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against us.

7.9. The Competition is in no way sponsored, endorsed or administered by Twitter and any correspondence related to the Competition should be directed at us and not Twitter.

7.10. We reserve the right to disqualify any entrant suspected of fraud or cheating including without limitations, through the manipulation of code or otherwise falsifying data.

7.11. Should any dispute arise in relation to these Terms and Conditions, the organiser’s decision shall be final and no correspondence shall be entered into.

7.12. Your entry and/or participation in the competition and/or your acceptance of the prize (in the event that you win a prize) constitutes your binding acceptance of the competition rules. 7.13. These competition rules will be construed, interpreted and enforced in accordance with the laws of the Republic of South Africa.
